Article 1 — Operator Information

This service is operated by the licensed real estate broker identified above. All real estate brokerage activities conducted through or in connection with this platform are carried out in accordance with the Building Lots and Buildings Transaction Business Act (宅地建物取引業法) of Japan.

Article 2 — Purpose

These Terms of Service ("Terms") govern the use of PROPHACKJAPAN ("PHJ," the "Platform," or the "Service").

PHJ is a members-only platform designed to provide information about Japanese real estate and to facilitate interactive information exchange between the Operator and its users.

Article 3 — Nature of the Service

1. PHJ is an information platform on which the Operator publishes property listings and related content.
2. Third-party sellers or brokers do not post listings directly on the Platform.
3. Access to and use of the Platform is free of charge.
4. If a real estate sale or brokerage transaction is concluded, the Operator may charge a brokerage fee in accordance with the Building Lots and Buildings Transaction Business Act of Japan.

Article 4 — Accuracy of Information

All information published on the Platform is provided for reference purposes only. The Operator does not guarantee the accuracy, completeness, or currency of such information.

Users shall make their own independent assessment and bear full responsibility for any decisions made on the basis of information obtained through the Platform.

Article 5 — No Investment, Legal, or Tax Advice

Nothing on the Platform constitutes investment advice, legal advice, or tax advice. Users are encouraged to consult qualified professionals before making any investment or legal decisions related to Japanese real estate.

Article 6 — User Eligibility

By registering for an account, users represent and warrant that they:

1. Are at least 18 years of age (or the age of majority in their jurisdiction, whichever is greater);
2. Have the legal capacity to enter into binding agreements; and
3. Will provide accurate and complete registration information.

Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account.

Article 7 — Prohibited Activities

Users shall not engage in any of the following activities:

• Conduct that violates applicable laws or regulations
• Providing false or misleading information
• Unauthorized reproduction, distribution, or modification of Platform content
• Involvement with antisocial forces (暴力団 or related organizations)
• Money laundering, financing of terrorism, or other illegal financial activities
• Unauthorized access, scraping, or interference with the Platform's systems or infrastructure
• Any action that may harm or cause inconvenience to the Operator, other users, or third parties

Article 8 — Exclusion of Antisocial Forces

Users represent and warrant that they are not, and do not have any relationship with, organized crime groups (暴力団), their members, affiliated enterprises, or any comparable individuals or entities.

The Operator may immediately suspend or terminate a user's access to the Platform if any such relationship is discovered.

Article 9 — Prevention of Money Laundering

The Operator complies with the Act on Prevention of Transfer of Criminal Proceeds (犯罪収益移転防止法) and related legislation.

The Operator may require identity verification (KYC), source-of-funds confirmation, or additional documentation as necessary to comply with applicable anti-money laundering regulations.

Article 10 — Intellectual Property

All content published on the Platform — including but not limited to text, images, data, designs, software, and trademarks — is the intellectual property of the Operator or its licensors and is protected under applicable intellectual property laws.

No license or right is granted to users except the limited right to access and view the Platform content for personal, non-commercial purposes.

Article 11 — Service Modification and Interruption

The Operator may modify, suspend, or discontinue all or part of the Service at any time without prior notice for maintenance, system updates, force majeure events, or other reasons deemed necessary.

The Operator shall not be liable for any damages arising from such modification, suspension, or discontinuation.

Article 12 — Disclaimer of Liability

Except in cases of willful misconduct or gross negligence on the part of the Operator, the Operator shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Service.

This limitation applies regardless of the legal theory upon which the claim is based, including but not limited to contract, tort, negligence, or strict liability.

Article 13 — Account Suspension and Termination

The Operator may suspend or terminate a user's account, without prior notice, if the user violates these Terms or if the Operator reasonably determines that continued access would be detrimental to the Platform, other users, or third parties.

Article 14 — Amendments to These Terms

The Operator reserves the right to amend these Terms at any time. Amendments will take effect upon being published on the Platform. The "Last Updated" date at the top of this page will be revised accordingly.

Continued use of the Service after amendments have been published constitutes acceptance of the revised Terms.

Article 15 — Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Japan.

The Tokyo District Court shall have exclusive jurisdiction of first instance over any disputes arising out of or in connection with these Terms or the use of the Service.
